Terms of Service

Welcome to TortillaNet. These Terms of Service (“Terms”) are an agreement between you and TortillaNet (“TortillaNet,” “we,” “us,” or “our”) governing your use of tortillanet.app and related services (the “Service”). By creating an account or using the Service, you agree to these Terms.
Joining communities and taking part in events is free. Hosting communities requires a paid Host plan, as described on our pricing page and in section 9 below.
1. Eligibility
You must be at least 13 years old to use the Service (or older where required by your jurisdiction). By using the Service you represent that you meet this requirement and that the information you provide is accurate.
2. Your account
You are responsible for safeguarding your login credentials and for activity that occurs under your account. Notify us promptly if you suspect unauthorized access. You may not share your account or impersonate another person.
3. Acceptable use
You agree not to use the Service to:
- Violate any law or the rights of others, including intellectual property and privacy rights;
- Post or share content that is unlawful, harassing, hateful, threatening, sexually explicit, or that exploits or endangers minors;
- Send spam, deceptive communications, or attempt to gain unauthorized access to accounts or systems;
- Interfere with the Service, introduce malware, or scrape or harvest data beyond what is necessary for normal use;
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
We may remove content or suspend or terminate accounts that violate these Terms or that we reasonably believe present a safety, legal, or operational risk.
4. User content
You retain ownership of the content you submit to the Service (events you create, RSVPs, contributions, broadcasts, group chat messages, photos, captions, etc.). By submitting content, you grant TortillaNet a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute that content as reasonably necessary to operate and improve the Service — including showing it to other members of your community, showing an event's group chat to people who can view that event without an account where its host allows, and delivering it via email.
You represent that you have all rights necessary to submit your content and grant the license above, and that your content does not violate any law or third-party rights.
5. Hosting events and inviting guests
If you host an event, you are responsible for the event itself, the location, and the safety and conduct of attendees. TortillaNet provides software to help you organize; we are not a party to your event, do not screen attendees, and are not responsible for what happens at events organized through the Service.
If you invite guests to a community or event, you are responsible for sharing invite links responsibly and only with people you intend to include.
Hosts choose whether guests may add photos and videos to an event, and may change that at any time. Turning guest sharing off does not delete anything already shared. Hosts also choose whether an event's group chat can be read, and posted in, by people without an account. These Terms apply to anything you post in a group chat whether or not you have an account. Hosts and community staff can also remove content posted to their events, as described in section 4.
6. Communications
By using the Service, you consent to receive transactional emails (and, if you opt in, text messages) from us and from hosts of communities you join, including RSVP confirmations, host broadcasts, and event reminders. You can stop these communications by leaving the community or deleting your account.
7. Our intellectual property
TortillaNet, including its software, design, name, and logo, is owned by TortillaNet and is protected by intellectual property laws. We grant you a limited, revocable, non-transferable license to use the Service for its intended purpose. These Terms do not grant you any other rights in TortillaNet's intellectual property.
8. Third-party services
The Service uses third-party providers (e.g. Supabase for backend, Resend for email, Netlify for hosting, Stripe for payments, and Twilio for our phone and SMS line, including voicemail recording and transcription). Events may also embed a video player from YouTube, Vimeo, or Collectivision, which loads from that provider when the event page is opened. Your use of the Service is also subject to those providers' terms where applicable. We are not responsible for third-party services we do not control.
9. Host plans and billing
Creating and running communities requires a Host plan, billed monthly in advance through our payment processor, Stripe, at the price shown on our pricing page. Plans renew automatically each month until you cancel. You can cancel at any time from your dashboard, and you keep hosting access until the end of the period you have already paid for. Except where required by law, payments are not refunded, though we review quality-of-service problems case by case.
If your plan ends or a payment cannot be collected, the communities and events you have already created remain available to their members, but you will not be able to create new communities or events until you have an active plan. A free hosting period we offer (for example, to early hosts or through an invite code) ends on the date we tell you, after which a plan is required to keep creating.
Members may contribute supporter credits toward their host's plan. Supporter credits are applied to that host's TortillaNet charges before any card on file, cannot be exchanged for cash, and are not refundable once purchased except where required by law. If we change the price of a plan, we will tell you by email before the new price applies to you.
10. Termination
You may stop using the Service at any time and request account deletion by contacting us. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including ownership, disclaimers, indemnity, and limitations of liability) will survive.
11. Disclaimer of warranties
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any content will be preserved without loss.
12. Limitation of liability
To the maximum extent permitted by law, TortillaNet will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service. Our aggregate liability for any claims arising out of or relating to the Service will not exceed one hundred U.S. dollars (USD $100) or the amount you have paid us in the 12 months before the claim, whichever is greater.
13. Indemnification
You agree to defend, indemnify, and hold harmless TortillaNet from and against any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your content, your use of the Service, or your violation of these Terms.
14. Governing law & disputes
These Terms are governed by the laws of the State of Oregon, USA, without regard to its conflict-of-law principles. You agree that any dispute will be resolved exclusively in the state or federal courts located in Lane County, Oregon, and you consent to personal jurisdiction there. Nothing in these Terms prevents either party from seeking injunctive or equitable relief in any court of competent jurisdiction.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. Material changes will be communicated via the Service or by email. Continued use after the effective date constitutes acceptance.
